A doctor who Richardson went to prior to the birth confirmed to authorities about the existence of the baby after Brooke said that she had a stillborn birth. Authorities investigated after the doctor's information where they found the baby's remains at her parent's home. According to County Prosecutor David Fornshell, the Richardson family was worried about their local community's reaction if they knew about Brooke's out-of-wedlock baby.

Despite claiming that the baby was stillborn, Richardson was charged with aggravated murder, involuntary manslaughter, endangering children, tampering with evidence and abuse of a corpse after newborn head was smashed.

Her trial will begin on September 3, 2019, in Warren County, Ohio. Her defense had already filed three motions delay the trial: some of which was to present the jury photos of the crime scene, Richardson's diary, and lighter fluid... but all were overturned by Judge Donald Oda II.
